Session Recap:
Yesterday’s Council session was its last until September, and possibly the final session for a number of Councilmembers harboring Mayoral aspirations. The marathon session, driven by a long calendar and ample public comment, also included a rare, public heated exchange between members over a city hiring measure. With no chance for passage before the fall, members held back on new legislative introductions with the exception of Councilmember Helen Gym (D-AL), who introduced a Home Rule Charter proposal to establish a new oversight structure for Philadelphia prisons. The proposed Charter Change would replace the current Advisory Board with a staffed civilian board with a defined mission, independent oversight, and investigative powers.
“Safety is our top concern for those housed in our prisons and those who work there,” said Gym. “With today’s introduction, we are taking a critical step in establishing an oversight body that has the power to ask questions and get answers, with a commitment to community engagement, transparency, and change that has been sorely lacking.”
Lengthy voting calendar
Council passed almost all of the bills and resolutions filling its twenty-one page Second Reading and Final Passage calendars, including all of the budget bills for the Fiscal Year 2023-2024 budget. Most of the bills passed yesterday did so unanimously, with some notable exceptions. The proposed reductions to the wage and business taxes championed by Mayor Jim Kenney (D), the various chambers of commerce and a number of Councilmembers passed by a 14-3 vote, with Councilmembers Kendra Brooks (I-AL), Jamie Gauthier (D-3rd) and Gym voting against.
Councilmember Katherine Gilmore-Richardson’s (D-AL) proposal to award bonus points to certain graduates of Philadelphia technical schools for city hiring purposes was the target of a number of veterans during the lengthy public comment period. In calling the package of bills to a vote, Gilmore-Richardson and Councilmember David Oh (R-AL) engaged in a rare and heated exchange about the proposal. Oh, a veteran himself called the proposal “unnecessary” and argued that it would devalue the service and negatively impact the chances of veterans getting hired for city positions. Gilmore-Richardson pushed back against Oh and the veterans’ characterization of the bills and then publicly derided the tactics and harassment that she felt was directed her way. She also noted that she made many amendments to the bill, at the request of the veterans in order to ensure they would still have the advantage when going head to head against a technical school graduate. Gilmore-Richardson also observed that voters would have the final say in this opportunity “to support young people” in advancing their careers and addressing the city’s hiring crisis.
Flirting with Resign to Run?
Following the conclusion of Council business, a number of members gave speeches on the floor of Council that had mayoral undertones to them. In a speech to his colleagues and the public, Councilmember Allan Domb (D-AL) noted that this "could be the last time I speak before Council in my current position." Domb unloaded on the Administration for what he called a lack of leadership around gun violence, the opioid crisis and poverty rates, “I say all of this to simply state, we deserve better. Philadelphians deserve a leader who will take action…a leader who actually wants the job.”
Domb inched dangerously close to declaring for the Mayor’s race, but to do so would have immediately triggered his resignation from Council. The Philadelphia Home Rule Charter contains a provision known as “resign to run,” which requires City elected officials to resign from office in order to seek other public office. This provision is typically triggered by fundraising specifically for the other office, or most commonly by a public declaration that the individual is seeking the other office. This public declaration provision allows individuals to “explore” or express interest in running, but does not kick in until a public declaration of a candidacy for that seat.
Domb is not the only elected with Mayoral aspirations to flirt with the public declaration provision of resign to run. City Controller Rebecca Rhynhart (D) sent supporters an email earlier this week expressing interest in a potential run for Mayor. Councilmember Maria Quiñones-Sánchez (D-7th) also noted during speeches that this could be her last session as a Councilmember. And all eyes were on Councilmember Derek Green (D-AL) when he was recognized to share a big announcement - that his dedicated Legislative Aide Frank Iannuzzi was leaving his office to join the Administration.
Historically, candidates for Mayor usually begin to go public in the fall, once the distractions of summer are in the past. Notable exceptions to this were the last two mayors. Then City Councilmember Michael Nutter announced his surprise resignation at Council’s final spring session in 2006. On the other end of the spectrum, Mayor Kenney did not declare his candidacy until January 2015, well after the other candidates had entered the race. With an extremely crowded Mayoral field anticipated, early commitments candidates typically hope could prove elusive with people and organizations waiting for the full slate of candidates to publicly declare.
