Session Recap:
Today’s Stated Meeting, the last of the term, was marked by a number of special appearances, speeches and the passage of over one hundred bills and resolutions. Council President Darrell Clarke (D-5th) dropped the gavel for the final time today, with both outgoing Mayor Jim Kenney (D) and Mayor-Elect Cherelle Parker (D) giving speeches praising his leadership and decades of public service.
Parker, referencing Robert Caro’s “Master of the Senate” called Clarke, the “Master of City Council.” She told the body that none of the legislative and policy platform that she ran on would have been accomplished “without Darrell Clarke by [my] side.” Mayor Kenney also offered up kind words about Clarke, calling him “a great friend and colleague.” Clarke’s retirement as Council President was the culmination of a meteoric rise from a constituent services staffer in then Councilmember John Street’s office. Clarke took over representation of the 5th Councilmanic District when Street was elected Mayor, serving North Philadelphia and parts of Fisthown and Center City. He succeeded Council President Anna Verna in the leadership position in 2011, becoming the second most powerful person in City Hall. Clarke will be succeeded by Jeffrey Young in the 5th District and by Kenyatta Johnson (D-2nd) as Council President. His role in public service will likely continue as a member of the Commonwealth’s Liquor Control Board. Congratulations were also in order for the other retiring Councilmember, Sharon Vaughn (D-AL), who capped off a career spanning over forty years in public service.
Legislative Highlights from Today:
Given the volume of bills and resolutions passed in the final session, here are some of the most noteworthy matters approved by Council today:
Unlawful Deportation of Noncitizen Patients: Council voted today to end the practice of “medical deportations,” where undocumented residents in need of long-term healthcare are deported to their nation of origin against their will. (Bill No. 230649, Jim Harrity D-AL).
Exonerated Conviction Protections: Employers are now prohibited from rejecting an applicant or employee from employment “based on a conviction that resulted in exoneration.” The Bill’s sponsor, Councilmember Isaiah Thomas (D-AL) explained, “We must give exonerated individuals a fair shot at life outside of prison and provide the necessary guardrails for housing, education, and job opportunities.” (Bill No. 230571)
Retail Establishment Trespassing: Council enacted a law providing that “no individual shall trespass in a retail establishment after they have been prohibited from entering by a business owner” and provided for a $1,000 fine for violations of the new law. (Bill No. 230700, Curtis Jones, Jr. D-4th).
New Bag Fee for Retail Establishments: Council further refined the City’s “plastic bag ban” in an attempt to increase the efficacy of the bill aimed at reducing single-use plastic use. The bill passed today further defines what types of bags are prohibited at checkout and requires retail establishments to charge customers a fee of 15 cents per bag. Protections for Displaced Contract Workers: Despite vocal opposition from various Chambers of Commerce, including the African American Chamber of Commerce and the Hispanic Chamber of Commerce, Council voted overwhelmingly to provide increased protections for certain displaced contract workers. Covered workers include those working in larger office and residential buildings in the following areas: security, janitorial, building maintenance, concierge services, door attendants, food and beverage, hotel service, health care services, parking employees and certain covered airport service employees. The bill provides for certain notice and a transition period for displaced covered workers. (Bill No. 230746, Jim Harrity D-AL)
Youth Name, Image and Likeness Protections: Philadelphia will be one of the first cities in the country to provide education and counseling to Philadelphia youth and families considering licensing publicity rights. As name, image and likeness (NIL) deals become more prevalent for younger athletes, the bill’s sponsor Councilmember Thomas noted it was important to ensure that Philadelphia youth “don’t get scammed and taken advantage of.” (Bill No. 220905, Isaiah Thomas D-AL)
Deemed Lapsed:
While Council passed most of the bills eligible for a vote today, those that were left languishing on the calendar will be deemed lapsed and must be reintroduced next term for any further consideration. The bills passed today will head to the Mayor’s desk. The Mayor must sign them before the end of the year for them to become law. Any bills that remain unsigned will be deemed lapsed and need to be reintroduced in the next term.

🔏 230774 (Johnson): Authorizing the Director of Aviation, on behalf of the City of Philadelphia, to acquire fee simple title or a lesser real estate interest in all or a portion of a parcel or parcels of land in and about the area bounded by Executive Avenue, Enterprise Avenue, I-95 and Penrose Avenue, more commonly known as 8350 Enterprise Avenue, Philadelphia, Pennsylvania.
🔏 230827 (Phillips): Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to enter into a sublease with the Philadelphia Municipal Authority, for use by the City, of all or a portion of the premises located at 1000 East Comly Street, Philadelphia, Pennsylvania.

🔏 230830 (Clarke): Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to enter into a lease agreement with The Leon Sullivan Charitable Trust, for use by the City of all or a portion of the premises located at 1415 North Broad Street.
