Session Recap:
Philadelphia City Council wrapped its spring legislative session Thursday, passing a significant number of bills and resolutions to clear its calendar before beginning its summer recess. Included in that package were the various bills compromising the city’s Fiscal Year 2026 budget. This year, the budget clocks in around $6.8 billion and contains significant financial investments in Mayor Cherelle Parker (D)’s Housing Opportunities Made Easy plan. Modest cuts to the City’s Wage Tax and Business Income and Receipts Tax are also included for this year, ramping up over the next ten years.
It’s important to note that while Council codified future year tax rates, these rates are not set in stone. As a practical matter, Council examines and adjusts tax rates on a year-to-year basis. Codifying future reductions in the city’s tax code is typically done as a symbolic gesture of future intent, rather than a binding future action.
The proposed tax reductions became the source of robust debate this budget cycle. A number of members of Council pushed back against cuts to the city’s tax rates, arguing that with funding uncertainty at the federal level and citywide service needs, that tax cuts were financially risky. Another faction on Council argued that the tax cuts were not aggressive enough and that the city was hurting its long term economic competitiveness. In the end, the middle ground won, with the following tax cuts enacted by Council Thursday, heading to the Mayor’s desk for her signature.

Elimination of BIRT and U&O Exemptions
As a result of an ongoing lawsuit, Council also voted to eliminate two tax exemptions designed to help lower the tax burden for small businesses. Earlier this year, Massachusetts based Zoll Medical Corporation filed a law suit challenging the city’s $100,000 exemption, arguing that it violated Pennsylvania’s Uniformity Clause, which requires taxes to apply equally to all taxpayers. As reported by the Philadelphia Inquirer, City Solicitor Renee Garcia explained, “When the BIRT exemption was adopted, some case law suggested that an income threshold like the $100,000 exemption would be defensible,” City Solicitor Renee Garcia said in a statement. “In recent years, the Pennsylvania Supreme Court has issued a series of cases that made it very clear the BIRT exemption is at risk. It is in City’s best legal interest to sunset the provision because the law has been clarified.”
The exemptions were wildly successful at ensuring small businesses were exempt from the tax. A Pew study conducted in 2024 found that almost 75% of businesses paid no BIRT taxes due to the exclusion. Mayor Parker’s budget took steps to try to mitigate the impact of eliminating the exclusion with BIRT reductions, as well as a fund to provide grants and technical assistance for businesses learning the process for filing BIRT returns.
The first non-exempt BIRT returns are due April 2026.
Increase to Realty Transfer Tax
Council also approved an increase to the city portion of the Realty Transfer Tax, from 3.287% to 3.578%. This increase is anticipated to raise approximately $173 million over the course of the Five Year Plan.
Other Council Business:
City Council, led by Councilmember Jim Harrity, held hearings on the ongoing use of synthetic herbicides in city parks, despite a Council ban on the chemicals.
Council President Kenyatta Johnson (D-2nd) sponsored a non-binding Charter referenda which would allow voter the opportunity to “call upon the Pennsylvania General Assembly to provide sustainable and consistent funding to mass transit throughout the Commonwealth, including to SEPTA.”
City Hall could be getting a road diet in the form of a new bike lane. Mayor Parker transmitted a bill to Council, introduced by Councilmember Jeffery Young (D-5th), which would eliminate a motor vehicle travel lane from around City Hall, replacing it with a bike lane.
A new bill introduced by Councilmember Isaiah Thomas (D-AL) would require individuals working as security guards to receive a minimum of forty (40) hours of training through a certified security training program. The stated purpose of the bill is to “ensure that security officers are trained in a range of essential skills including counterterrorism, crime prevention, fire and other building safety, disaster recovery, first aid, community health and wellness, and coordination with police, fire, and emergency personnel during an emergency.”
