Session Recap:
Today was City Council’s last session before its summer recess. With consideration of any new legislation delayed until the fall, Council’s focused on clearing off its lengthy Final Passage Calendar. Council gave final approval to the Fiscal Year 2024-2025 budget, including the passage of business tax reductions.
The session also featured a rare stand by the Mayor against Councilmanic Prerogative. Mayor Jim Kenney (D) returned two bills to Council without his signature. Bill No. 230308 and Bill 230318 are both overlay bills. As explained in an article by Inquirer reporter Jake Blumgart,
Overlays are like patches on the [City’s Zoning ] code. They create a hyperlocal set of rules for a specific section of the city, giving every City Council district its own idiosyncratic take on zoning rules.
Bill No. 230308 expressly prohibits smoking lounges in operating in the “South Street / Head House Square Area” overlay. Bill No. 230318 creates the “East Poplar Overlay District,” an area bounded by Spring Garden Street and Girard Avenue and Sixth and Ninth Streets. The bill would prohibit the construction of roof decks and limit building height in the overlay district to be no higher than the tallest structure on an adjacent lot. By returning the bills unsigned to Council, the Mayor is signaling his disagreement with the legislation while not providing for an outright veto of the legislation. Under the Home Rule Charter, unsigned bills automatically become law ten (10) days after their passage by Council.
In a stronger show of opposition, the Mayor issued a rare veto to Bill No. 230319, another overlay bill which expands the size of the “4th District Overlay” to include additional areas of the Wynnefield neighborhood. The bill would require certain consumer goods businesses to meet heightened zoning requirements, including those selling food, beverages, groceries, sundries, pharmaceuticals and convenience sales. The Planning Commission testified against the bill cautioning:
The proposed use restrictions are likely to further slow business growth on City Avenue and create an additional hurdle for new businesses, large and small. The uses targeted in this bill are common and necessary for sustaining neighborhood quality of life. Requiring prospective businesses to retain an attorney and face delay and uncertainty of a special exception hearing will undoubtedly discourage the establishment of new businesses and expansion of existing businesses. It will disproportionately affect business owners with limited access to capital who have trouble affording the additional legal costs and time associated with the zoning appeal.
In a speech on the floor of Council, the bill’s sponsor Councilmember Curtis Jones, Jr. (D-4th) urged his colleagues to override the Mayor’s veto, warning “Today it’s Wynnefield, tomorrow it’s your district.” Jones went on to criticize the by-right allowances of the Zoning Code, saying that the reforms enacted in 2010 created a situation in which business owners can “walk by all the stakeholders and do whatever they think they can get away with.” Jones stated that while “the businesses in this bill may not be considered nuisances to you, they are a pain in the ass to me.” He cited businesses selling liquor by the drink at all hours of the day. He defended Councilmanic Prerogative, concluding, “If we cannot self-govern and begin to determine what is acceptable, then why are we here?”
Council unanimously overrode the Mayor’s veto by a vote of 15-0.
Council stands adjourned until Thursday, September 14th at 10 AM.

🔏 230450 (Clarke): Authorizing the City Treasurer, on behalf of the City, to enter into an amendment agreement with Citizens Bank National Association for provision of payroll banking services to the City.
💸 230451 (Clarke): Approving the Fiscal Year 2024 Capital Budget providing for expenditures for the capital purposes of the Philadelphia Gas Works, including the supplying of funds in connection therewith, and acknowledging receipt of the Revised Forecast of Capital Budgets for Fiscal Years 2025 through 2029.
🔏 230452 (Clarke): Authorizing and approving the execution and delivery of a Supplemental Service Agreement to the Service Agreement between The City of Philadelphia and the Philadelphia Redevelopment Authority relating originally to the financing of a home repair program for City homeowners previously authorized by the City pursuant to Ordinance (Bill No. 170878) of the Council of the City, approved by the Mayor on December 12, 2017; authorizing the amendment of such program to include the Turn the Key Program, bridge and other loans for tax credit projects, and other affordable housing production programs; and authorizing City officials to take other necessary or appropriate actions to effectuate the purposes of this ordinance.
