Session Recap:
City Council and the Mayor were hoping to wrap up FY2026 budget negotiations last Wednesday, but a swift resolution of the outstanding issues was not in the cards. Negotiations lasted late into the night, with Council not going home until the early hours of Thursday morning. With no agreement between the Administrative and Legislative branches, Council recessed the three committees with outstanding budget and H.O.M.E. (Housing Opportunities Made Easy) Initiative matters until after the start of its weekly Stated Meeting. In a rarely used procedural maneuver, Council President Kenyatta Johnson (D-2nd) bifurcated the Stated Meeting into a morning and evening session. Council reconvened in the late afternoon to vote the budget bills out of committee and they received first reading at the evening Stated Meeting session. This means Council is on track to take a final vote on the $6 billion worth of budget bills this Thursday, June 12th, before breaking for its summer recess.
While most of the Council session was focused on clearing its calendar for the summer, there were a few noteworthy pieces of legislation introduced into the pipeline.
Additional Requirements for City Contractors
Councilmember Jim Harrity (D-AL) introduced a bill on Thursday to add “Additional Workforce and Contractor Qualifications” for public works projects valued at $100,000 or more. Under the proposed bill, all contractors and subcontractors that work on the qualifying public works projects must have at least 70% of its on-site workforce successfully complete “a certified apprenticeship program recognized by the Commonwealth of Pennsylvania’s ‘Apprenticeship and Training Act.” Bidders would be required to provide documentation proving compliance as part of their bid submissions. Firms that fail to meet those requirements would be deemed “not responsible" and would be disqualified from bidding or performing work under covered public works contracts.
Return of the 92nd Police District?
Philadelphia was rocked by an outbreak of gun violence over Memorial Day Weekend which saw two people killed and nine people injured. Councilmember Curtis Jones, Jr. (D-4th), whose district includes most of Fairmount Park, introduced a resolution authorizing hearings to “examine the potential reinstatement of the 92nd Police District, formerly the Fairmount Park Police.” The 92nd Police District operated out of Wissahickon Hall, a historic building on Lincoln Drive and Gypsy lane. The district operated from the 1970s until its disbanding in 2008 as part of the budget cuts necessitated by the Great Recession. Prior to the 92nd, Fairmount Park was patrolled by the Park Guard which operated from the early 1900s until the Philadelphia Police Department assumed responsibility in the 1970s.
Criminal Screening Bill Amended and Held
One of the dozens of bills that Council met last week to consider was Councilmember Rue Landau (D-AL)’s bill to amend the city’s “Fair Criminal Record Screening Standards,” which was covered in detail in a previous newsletter. At the hearing, Councilmember Landau offered a series of amendments, the result of conversations with various business leaders and stakeholders. The amendments include:
Extension of the lookback period for misdemeanors from 3 to 4 years;
Applying notice requirements only to employers with over 10 employees;
Providing for a four question explanation of why an employee is being rejected, rather than a free-form narrative to help simplify compliance for employers; and,
Eliminating the immediate private right of action, reverting to the existing private right of action standards.
While the bill was moved out of committee with a favorable recommendation, Councilmember Landau stated that she plans to hold the bill over the summer to allow for further conversations with stakeholders. The amended version of the bill can be downloaded in full, here.
