Session Recap:
Seventh Councilmember resignation of the term
Councilmember David Oh’s (R-AL) last Council meeting was like many over the course of his eleven-year career as an elected official, one spent debating colleagues over his proposed legislation. At the February 9th Stated Meeting, City Council voted down Oh’s resolution urging the Philadelphia Police Department to implement “minimum force training,” after a lengthy and sometimes heated floor debate. For a body renown for their public displays of collegiality, Oh has often been the exception to that rule, sparring with fellow members over both the process and substance of his legislation.
Undaunted by his colleagues latest rejection of his proposals, Oh announced on Monday his resignation from Council to seek the Republican nomination for Mayor. In his time on Council, Oh’s most publicly enduring effort surrounded the creation of “PHL Live” an annual music competition, designed to lift up local artists. Oh has often broken with his colleagues on votes around the budget and financial matters. Citing this independence, Oh has framed himself as someone “who knows how government works from the inside but has fought it like an outsider.” In addition to painting himself as an “outsider,” Oh has loudly proclaimed his support for law enforcement, promising to “build up our Police Department to make it the finest in the nation…They will be equipped with the best tech [and] supported with reliable equipment.”
Oh’s resignation from Council is the seventh of this term, with Allan Domb, Derek Green, Helen Gym, Cherelle Parker and Maria Quiñones-Sánchez each resigning to run for Mayor and Bobby Henon resigning following his federal criminal conviction.
Council Fills its Committee Hearing Dance Card
With the Primary Election rapidly approaching, City Councilmembers have become more active in the introductions of bills and resolutions. Specifically, we’ve seen a recent spike in the number of public hearing resolutions authorized by the body on a variety of topics. Unlike the committee hearings for bills, there is no proposed ordinance being considered and no vote taken. Instead, Council takes public testimony on a given issue for the sake of building a public record on the particular topic.
Why the sudden flurry of activity around committee hearings?
First is the reality that City Council is limited in its legislative authority. Council may have a number of ideas of how the Mayor and the many city Departments can do their jobs better. However, departmental operations fall fully within the purview of the Mayor. A public hearing examining an operational issue is sometimes the next best alternative where direct legislative action is not a possibility.
Second, public hearings are often a great way for Councilmembers to make clear their priorities in advance of the annual budget process, in which they wield a lot of power. While Council cannot always legislate their priorities into existence, their important role in the budget process can often result in departments implementation of Council’s policies.
Third, public hearings are a great tool for learning more about a topic from both experts and impacted residents. They also show voters the Councilmember’s interest in a topic. Frequently, the information and insight gathered during public hearings often forms the foundation for subsequent legislation.
Lastly, public hearings are just that - very public. In an election year, they can be an important source of earned media for officials seeking reelection
